Why did I become a mediator?  As a litigator for 30 years, I saw the benefits of mediation versus going to court.  It is my goal to find a way to help people resolve their issues without having to resort to litigation.  While mediation is not a perfect solution for all matters, here are some reasons why I chose to become part of the solution.

Actual Costs of Litigation

As a litigation attorney.  I saw that even when my clients won their cases, they lost in a way due to attorney’s fees being so excessive.  In addition, often attorney’s fees may not be recoverable in the case or worse, recoverable but the other side can not pay them.  In fact, a Duke University study showed that for every dollar spent in litigation, 40% went to paying awards or settlements, 60% went to litigation costs.  It can become disillusioning to win only to lose through mounting litigation fees and costs.

Seeing the Other Side

I also consider myself someone who’s good at seeing other people’s points of view.  Seeing both sides, trying to understand what they’re trying to portray and their reasoning for their positions helps me be an effective mediator.  As an experienced litigation, I find it important to help the parties understand how those positions are going to play out in the litigation process.

In Summation

Why did I become a mediator?  There are several reasons why, but the reality is I want to make a difference.  I want to contribute to resolution rather than turmoil.
